My Lord Inclosed is a recommendation for sherifs for the county of Botetourt and as I have the honour to be first on the list take liberty of requesting the favour of your Lordship to grant me the commission; I should have attended upon the division of the county to set forth my claim had I not been prevented by sickness which confin’d me at home, but hope anything that was then done will not prejudice me now; it may perhaps be thought that the court in leaving out W. Woods did not pay proper regard to your Lordships appointment, but as the court looked upon your authority in this case to be no more than it would have been in the death of a sherif where the power of appointment would have been vested in you only till a recommendation had been made by the court and as they looked upon W Woods’s tittle not to be a good one he haveing had the commission before the county was divided; thought proper to begin with those in our commission who next would have been intitled to the sherifalty had the county not have been divided This they thought was doing justice to all parties, for thereby they are to be sherifs in the same order in which they stood in the augusta commission; I am informed that the reason of your Lordship’s appointing W Woods was that he had been out of office longer than those now recommended had been in the commission; this may possibly be the case tho I do not know it be so; but admitting it to be true W Woods could not be justly intitled to it even upon his own principle, for there is another acting magestrate in our commission who served as sherif before W Woods and who since has being out of office has constantly attended court as a magistrate which was not the case with W Woods, for he seldom went to court, and hardly ever set to do bussiness when he was there These were some of the reasons given for leaving him out another was that as we had upwards of 30 magistrates in our county had they begun with those who are first in the commission many of the others probably would never have had the benefit of the sherifs place at all; whereas
