To Mr. Samuel Wren Take notice, that on Thursday the first day of September in the year of our Lord 1839, between sunrise and sunset of said day, I shall [illegible] at the residence of Doctor Benjamin F. Rose, at Lyons in Fayette County State of Texas, to take the deposition of the said Benjamin F. Rose to be read as evidence in a suit, now pending, and [undetermined?] on the common law side, of the Circuit Court, for the County of Fairfax, and State of Virginia, in which I am plaintiff and you are defendant, and if from any cause the said deposition, shall not be take on said day, the taking thereof, will be continued, from time to time, until the same shall be completed.
