Robert Draffen complains of Thomas Whitlaw in custody &c. of a plea for this to wit that whereas the defendt. on the [blank] day of [blank] in the year [blank], at the parish of [blank] and county aforesaid offered to sell to the pltff a certain negroe woman of him the said defendt. and whereas afterwards to wit on the day and year aforesaid at the parish and county aforesaid in consideration that the pltf at the special instance and request of the defendant would buy of him the deft. the said negroe wench at and for a certain large price or sum to wit the price or sum of [blank], to be paid by the said pltf to the said defendt when the said pltf should be afterwards thereunto requested he the said defendt undertook and then & there faithfully promised the sd pltf that the said negroe wench was sound, and the said pltf in fact saith that he confiding in the said promise & undertaking of the said defendant so by him made as aforesaid, afterwards to wit on the same day and year aforesaid at the parish and County aforesaid at the special instance and request of the sd defendant did buy of the said defendt the said negroe wench at and for the said price or sum of [bland space] and did then and there pay and satisfy to the defendt the sum of [blank space] aforesaid: Yet the said Thomas not regarding his promise and undertaking so by him made as aforesaid but contriving and fraudulently intending to injure the said Robert in this behalf did not regard his said promise and undertaking so by him made as aforesaid but craftilly and subtilly deceived the said Robert in this that the negroe wench at the time of making the said promise and undertaking of the said Thomas was not sound but then was unsound whereby the said negroe wench became and is of no use or value to the said Robert By reason whereof the pltff saith he hath [illegible] & thereof he brings suit [illegible]
