Conn, and negroes Tom, Lucy, William, Nelson, Elizabeth, Evelina, Dan, Isabella, Jackson, John and Betty, who were emancipated by the will of said Raphael Conn dec'd Defendants. } In Chancery

Jas. R. Robertson appointed guardian ad litem to infant Defendants - but not to be subject to Costs -his answer filed and replication thereto and set for hearing: And this cause came on to be heard this 4th day of Sept'r 1833, upon the bill, exhibits, the answer of infants defendants and adult defendants, Elizabeth, Sophia, William and Nelson and replication thereto, and as to Mary J. Conn it is taken for confessed, the spa: having been executed and bill filed more than four months, and she still failing to answer: On consideration whereof the court doth adjudge, order and decree that the exor of said Raphael Conn pay to said Mary J. Conn Three Hundred dollars the amount of her legacy, out of the proceeds of sale of the personal estate that the residue of the personal estate, and the fund provided by the Will of said Raphael Conn for payment of his debts, be applied to that purpose, and if insufficient, that the slaves who were emancipated, are to be hired out to raise a sum sufficient to pay the balance of the debts and the Costs of this suit. And that the Exor. of the said Raphael Conn dec'd. do settle his executorial account upon the Principles of this decree, before William R. Almond, who is hereby appointed a special Commissioner for that purpose, who after being first duly sworn to settle the said account, shall proceed to settle the same, - and make report of his proceedings herein the Court, in order to a final decree.
