Hardin & wife vs. Bragg. This cause came on this 24th day of Nov. 1846 to be further heard upon the papers formerly read in the cause a second report of commissioners Jno. S. Moon and Wm. H Jones and exhibits recently filed, Whereupon it appearing to the Court that said commissioners Moon & Jones are entitled to a compensation for selling certain negroes as mentioned in their first report in this cause bearing date the 26th Jun. 1846 on motion of said commissioners it ordered adjudged and decreed that said commissioners be authorized and allowed to retain out of the funds in their hands in full satisfaction of such right to commissions the sum of $25.80 That sum being five pr cent on the amt for which said negroes were sold by them; And is further appearing to the Court that the pltff. Louis Hardin who because the purchaser of one of said negroes sold as aforesaid and executed his bond with Robt. A. Rust as security therefor, has failed to pay said bond and said Hardin being desirous that his said bond shall be credited by a sum equal or nearly equal to the amt. he is entitled to recover out of the proceeds of the sale of said negroes. On motion of said Louis Hardin it is ordered adjudged and decreed that said Hardin's said bond be credited by the sum of $163.40/100 with interest thereon from the date of said bond and thus commissioners Moon & Jones be and they are herby directed to endorse said credit on said bond. And it further that Wm. N. Bragg is entitled to recover the further sum of $99.01 in addition to what has already been decreed him and after reserving $10. to cover any proportion of the costs of this suit that may be decreed against him and that said Wm. N. Bragg has paid into the hands of said commissioners Moon & Jones the sum of $12.92 with their bond. On Motion of said Wm. N. Bragg, it is further ordered adjudged & decreed that Louis Hardin & Rob. A. Rust's bond after said credit is -
