Northampton Co To the Worshipfull the Justices of the County all in a Court of Chancery Sitting Humbly complaining sheweth unto your Worships your orator Phillip Jacob of the County af'd states that your orators father John Jacobs of the County af'd decd in his life made his will bearing date the Eighth day of Febry Seventeen hundred twenty & Eight whereby after Sundry wishes & bequests to Sundry Legatees in the said will nam'd he {illegible} the residue of his Estate equally to be divided among his four sons viz Esau Jacob, Tho's Jacob, Isaac Jacob & your petitioner & Mary the wife & Est of the Said John Jacob, that his Estate should not be apprais'd but divided by the Overseers by his said Testator appointed to Divided his Estate according to his will who were Berry Foleyd, Jonathan Hot, & John Roberts Junr & having so made his will af'd soon after dyd, which said will Since that time has been duly prov'd before this County Court & a distribution of the Said testators Estate made by his overseers af'd & Return'd to Court & Recorded as by the Record thereof before the Justices here remaining may appear an Exemplification whereof your Orator here into Court brings & prays may be made deem'd or taken as part of his Bill of Complaint, And your Orator further Sheweth your worships that amongst the other things Set apart for your Orators sharae of the said Residuary part of his Said fathers Estate there was likewise Set apart a negro woman named Judith by the Said testator his his life time & at the time of the Said John Jacobs death Claim'd as his proper Slave & regarded as Such by the Said overseers in the Distribution of the Said Jacobs Estate, which the other Sharers of the Said Estate well know & which your orator hopes he shall be able to prove to your worships if the Same should be deny'd by the Defendants, but So it happened may it please your worships that after Such Distribution the Said Negro woman Judith made appear on a Suit for that purpose brought before your worships & by the Consideration of the Said Court was declared a free woman - And your Orator further Sheweth that your Orator was at Great Expence in defending the Said Suit to the value of five hundred & Eighty two pounds of tobacco & thirty {shils?} or three hundred pod of tobacco & forty {shils?} Curt money & fifteen bushels of Indian Corn
