Hepburn and Amelia R. his wife, to the said C. W. Wattles, and S. Ferguson Beach, dated the 25th day of May 1853, and filed in this cause, securing the payment of a bond expected by Moses Hepburn for the sum of sixteen hundred dollars ($1600) which said bond is hereby declared, satisfied and cancelled. And the event of the further, order, and decree that the unpaid costs in this suit (except the costs in the event of appeals in the appeal of Cooper vs Hepburn) be paid out of the funds in the hands of the said comr of sale, and that the costs in the said appeal amounting to $44 94/11 be paid by Lewis Cooper to the children of the said Moses Hepburn decd. The Commissioner of sale is not to make any further report unless required by some of the parties interested We agree to the rendition, and entry of this decree. Nov. 27th, 1865.
