Peirce vs Peirce's Adm &c } In appearing to the Court that since the last order entered in this case Reubin Brooke one of the defendants had died, leaving Ann S his wife surviving it is ordered that this cause henceforth proceed in the name of Ann S Brooke in her own right, - and the cause coming on again to be heard upon the papers formerly read, and the report of Commissioner Baker of the 11th Sept 1852, was argued &c where upon the Court without confirming the said last mentioned report, or deciding any other matter or thing but what follows doth direct the clerk of this Court to deliver to the adult parties entitled, and to the guardians of the infant parties, or to their attorneys, the bonds taken for the sale of the real estate, and heretofore returned and filed with the reports of Commissioners Mayo, Mason Claybrook & Beale - and the said Commissioners or any one of them is directed, upon the payment of the said bonds by the purchasers of the land, to execute to the said purchasers the necessary and usual deeds, with special warranty.
