Circuit Court for the county of Nelson } The demurrer of Francis N Farrar defendant to the Bill of complaint of Frances L Farrar & James S Farrar. This defendant by protestation not confessing or acknowledging all or any of the matters are things in the said complainants Bill contained to be true in such manner and form as the same all therein set forth doth deliver thereto due for cause of demurrer showeth that the said complainants by their own showing are not entitled to relief in the court for they have no right to sue for the negroes mentioned in the bill either at law or in equity. For the trustee is the proper person to sue and the purchaser the proper person to be sued. For the recovery of these negroes or their accumulative value is properly the subject of a suit in detinue wherefore and for divers other defects 9 causes of demurrer appearing on the said complainants bill this defendant doth demur thereto and humbly demands the judgement of this honorable court whether he shall be compelled to make any answer to the said bill & prays to be hence dismissed with his reasonable costs on this behalf most wrongfully sustained Brown & Whitehead pq
