The deposition of Jos H. Roberts taken at the Office of R Whitehead Commissioner of Accounts in the Circuit Court of Nelson County on the 14th day July 1853, to be read as evidence in a cause now depending in the Circuit Court of Nelson County, in which Frances L Farrer and others are Plaintiffs against Francis N Farrar and others defendants. The deponent being duly sworn deposeth and saith Question by F. N. Farrar (In absence of counsel the Comr propounded the questions for the party, upon the questions stated by him) Have you had any conversation with Frances L Farrar the plaintiff in the cause, about the sale of the negro girl Lizzy if so state it? Ans. Yes she told me she had made a contract to sell the girl Lizzy and lay out the money in Land but her son Francis N Farrow objected to the trade and asked me if she could as the property was trust property I told her I thought she could not sell the girl and make a good title without the consent of all the children she said she would make the trade if he did object that the land could not die or runaway not withstanding he objected, she said that all the Rest of the children ware willing.
