The undersigned who was appointed a com'r to advertise for claimants to a certain part of the fund arising from the sale of the interest in the land in the proceedings mentioned, and which was sold by the said cousin under a former decree in this cause, begs leave to report that he proceeded to execute the order of the court and cause the same to be inserted once a week for 4 weeks in the Raleigh Standard and also in a Fayetteville NC newspaper and paid therefor the sum of six dollars - that he further carried on a correspondence with several persons in No. Carolina who addressed him and who claimed to be or supposed they might be heirs of the said Dr. Thos. Stewart - that he also had personal interviews with two or three persons representing others who thought they might be entitled to shares of the said fund - The result of all his inquiring, your commissioner further reports is that of all his correspondents and of the applicants to him claiming or supposing themselves to be entitled, one Jordan Stewart is the only one of them all who is believed by your com'r to be entitled. The principal part of the correspondence which goes to show that the said Jordan is entitled is filed among the papers and referred to as the ground on which your com'r believes that the said Jordan is entitled. The only point not covered by the evidences of the correspondence filed, is the allegation of the said Jordan that the paper purporting to be a sale of his interest for three dollars to [blank] Berry in 18[blank] is not his act - and on this point the certificates raise a presumption that the signature to that paper is not genuine.
